Effects on the rejection of Executive Order 1,045 – Filing of administrative responses and appeals
On September 1, 2021, the Brazilian Federal Senate, in voting, rejected the conversion of Executive Order No. 1,045 (MP 1045) into Law.
The MP 1045 had as its object the extension of the extraordinary measures to protect employment and income as a result of the New Coronavirus Pandemic, among other provisions, such as the suspension of deadlines for the filing of administrative responses and appeals in the administrative proceedings of labor infraction notices and on FGTS debts.
With the rejection of the procedure of MP 1045 by the Federal Senate, the Department of Labor Appeals General Coordination issued the Guideline No. 4/2021, clarifying that as of September 2, 2021, the suspended deadlines mentioned above must be resumed.
Thus, notifications for the filing of administrative defenses and appeals received by employers during March 17, 2020 to September 1, 2021 must be resumed from September 2, 2021.
