Enacted law No. 14,611/2023 which regulates salary gender discrimination and compensation criteria report

Law 14,611/2023 was enacted on July 4th, 2023, reinforcing the Brazilian Labor Coded guarantees for female employees regarding salary discrimination and determining an administrative fine of ten (10) times the monthly salary for employers who discriminate female employees by paying them lower salaries. Such fine is doubled in case of recurrence of such practice.

The new legislation also determines relevant report obligations to employer, including publishing a salary and compensation transparency report every six months for companies with 100 or more employees, which will be further regulated by a Decree and without prejudice of complying with the data protection laws.

In case of non-compliance with such obligation, the employers will be liable to pay administrative fines up to 3% of their monthly payroll, limited to one hundred (100) national minimum wages.

We will continue to follow up the matter and the enactment of its regulation.
