Covid-19 | Tennis academy is authorized to operate in the midst of the closure of non-essential activities due to the pandemic

The Special Panel of the Court of Appeals of São Paulo granted an injunction to authorize a tennis academy to resume its activities as long Covid-19 prevention measures are taken.

The academy filed a writ of mandamus against the São Paulo Governor’s act (Decree n. 64,881/2002) that declared an emergency state due to the Covid-19 pandemic and ordered the closure of non-essential services.

Upon granting the injunction request, Judge Soares Levada stated that individual sports such as “walking, cycling and tennis, in which physical contact and gathering are virtually absent, besides improving cardiac and respiratory capacities, must have a differentiated treatment” in the context of the Covid-19 pandemic control measures.

The State of São Paulo has filed an appeal against such ruling, which is still pending analysis.
