Covid-19 | Senate Bill Proposes temporary changes to private laws during epidemic

The Senate is currently discussing Bill No. 1179/2020 (full text here), proposing a emergency and transitory legal regime for Private Law relations during the coronavirus pandemic period, covering, among others, (i) statute of limitations, (ii) termination and amendment of contracts, (iii) consumer relations, (iv) real estate rental agreements, agrarian contracts and (v) competition regime.

The proposal submitted by Senator Antonio Anastasia (PSD/MG) does not necessarily invalidate existing rules but regulates their effectiveness. According to the Senator, the bill represents a minimum state intervention in private relations to avoid the expansion of the “generalized default” and anti-competitive practices.

Some of the rules contained in the bill will be presented by the president of the Brazilian Supreme Court and of the National Council of Justice (CNJ), Minister Dias Toffoli, as recommendations from CNJ to judges.

The Bill before the Senate and possible recommendations from the CNJ are still pending deliberation.
