Statement of Economic-Financial Information to the Brazilian Central Bank – Deadline March 31, 2021

All Brazilian companies that receive direct foreign investment must update, at least once a year, their economic-financial information with the Electronic System of the Central Bank of Brazil (SISBACEN).

Until March 31, 2021, all Brazilian companies that had direct foreign investment on December 31, 2020 shall provide the Statement of Economic-Financial Information related to such date in the Electronic Registration of Direct Foreign Investment (RDE-IED) of the Brazilian Central Bank, subject to fines that may be imposed by the Brazilian Central Bank, in case of non-compliance, according to the regulation currently in force.

Companies with direct foreign investment that, on December 31, 2020, had total assets or net equity equal to, or exceeding, BRL 250 million shall provide three additional statements during the year, respecting the deadlines of June 30 (with respect to the reference date of March 31), September 30 (with respect to the reference date of June 30) and December 31 (with respect to the reference date of September 30).

Statement of Brazilian Capital Abroad (CBE) to the Brazilian Central Bank – Deadline April 5, 2021

All legal entities domiciled in Brazil, holders of assets outside the national territory in an amount equal to, or greater than, USD 1 million (according to the National Monetary Council – CMN Resolution No. 4,841, of July 30, 2020), on December 31, 2020, have the obligation to report to the Brazilian Central Bank the statement of Brazilian investments abroad, subject to fines that may be imposed by the Brazilian Central Bank, in case of non-compliance, according to the regulation currently in force.

The statement must be provided by means of a reporting form of Brazilian Capital Abroad (CBE) no later than April 5, 2021, at 6 p.m.

Brazilian companies holders of assets outside the national territory in an amount equal to, or greater than, USD 100 million on December 31, 2020, shall provide three additional statements during the year, respecting the deadlines of June 5 (with respect to the reference date of March 31), September 5 (with respect to the reference date of June 30) and December 5 (with respect to the reference date of September 30).

The same obligation applies, under the same conditions, to individuals residing in Brazil who have assets outside the country in amount equal to or exceeding USD 1 million on the reference date of December 31, 2020.
