Covid-19 | Restaurant obtains injunction to reduce its rent under the pandemic
On 2/4/2020, a restaurant in São Paulo was granted a preliminary injunction to reduce its rent during the Covid-19 pandemic.
The restaurant claimed a 90% reduction, but the Court ordered the payment of 30%, of the amount due monthly.
The ruling stated that the compulsory closure of the restaurant’s in room activities due to the Covid-19 pandemic “caused the plaintiff’s income to decrease severely, rendering the rental payments at the original amounts excessively harmful to its financial health, with the risk of causing the company’s bankruptcy”.

On 4/7/2020, the defendants filed an interlocutory appeal, which is pending with the São Paulo Court of Appeals.
