Covid-19 | Court of appeals stays the effects of injunction that ordered airline company to immediately refund customers of flights affected by the pandemic

The Court of Appeals of Paraíba stayed the effects of an injunction that had been granted in a class action filed by the Consumer Protection Authority (Procon) which ordered an airline company to immediately refund customers of flights affected by the Covid-19 pandemic.

The ruling (full wording here) stated that “the cancellation of tickets with immediate refund may cause a real collapse of its [the airline company’s] cash and liquidity capacity, creating immense difficulties in the payment of employees, service providers and suppliers“.

The airline company was ordered to comply with the provisions of the Provisional Measure n. 925/2020, which states emergency parameters to civil aviation due to the Covid-19 pandemic, establishing a 12 months’ timeframe for refunding or rescheduling flights as of the original take-off date. This ruling is not yet definitive and is subject to confirmation or modification by the panel which will rule upon the merits of the appeal filed by the airline company.
