Covid-19 | Court of Appeals of São Paulo suspends debt collection against a travel agency due to the pandemic

On 5/19/2020, the Judge Carlos Abrão, from the 14th Chamber of Private Law of the Court of Appeals of São Paulo suspend the collection of amounts owed by a travel agency to an airline company for 60 days.

The measure was requested by the travel agency on the grounds that its activities were totally paralyzed due to the pandemic. The request was denied by the lower court.

The Court of Appeal’s decision mentioned that the tourism sector is one of the most affected by the pandemic and also pointed out that “the airline company cannot allow itself to reimburse tickets for an extended period of time and, at the same time, deny the same right to its suppliers, forcing prompt payment, without billing, under the pretext of issuing tickets and providing services”.
