Covid-19 | Tourism company is condemned to fully refund the consumer couple for the canceling of the trip due to the pandemic
On May 7, 2020, the Jundiaí Special Civil Court ordered a tourism agency to fully reimburse the amount paid by costumers for the cancellation of a travel scheduled to be held in May 2020 due to the pandemic caused by Covid-19.
According to the decision, “the reinstatement of each party to the state prior to the purchase is the best option” and he emphasized that the consumer cannot be forced to make the trip on a date other than that chosen, “if this is not their intention, for a circumstance to which they did not give cause and under penalty of suffering economic losses”.
