Covid-19 | São Paulo State Court of Appeals authorizes store in Shopping Mall to not pay rent while its activities are suspended due to the pandemic

A Antix, women’s and children’s clothing trading company, was granted a decision to suspend the payment of rent of a store located in a Shopping Mall until the normalization of its cash income, given the current scenario caused by COVID-19.

The store chain alleges to be unable to carry out its activities, due to the closure of the Shopping Malls ordered by the relevant authorities.

For this reason, the Judge of the case granted a preliminary injunction, acknowledging that the damages caused to the commercial activity by COVID-19 were uncontroversial.

As a result of the decision, Antix will be allowed to not pay the rent “until the suspension of activities and restriction of circulation of people is allowed“.
