Covid-19 | Justice authorizes the suspension of protests against commercial associations due to the pandemic

The trade and business associations of Dracena, SP and Presidente Prudente, SP obtained judicially the suspension of the registration of protests and inclusion in the credit protection agencies of companies associated to them for 90 and 60 days, respectively.

The requested was justified on the difficulties caused to theses measure to companies that are working on how to obtain loans from banks, which is necessary to overcome the economic crisis resulting from the pandemic.

The judge of the 3rd Civil Court of Dracena, SP granted the requested for the period of 90 days based on the arguments that “there is a risk that creditors extract representative title of protest credit against companies, as it has immediate harmful effects and can cause economic and financial difficulties even more harmful“.

On the other hand, the judge of the 1st Civil Court of Presidente Prudente, SP granted the request for the period of 60 days, under the justification that “the commercial sector and business is one of the most affected by the pandemic due to the restriction of the sector’s activity and that the credit lines to help entrepreneurs require precisely proof of registration regularity”.

So far, no appeals have been filed against the decision.
