Covid-19 | Judge authorizes the execution of a warrant by a bailiff, through the Defendant's email or telephone
The Judge of the 2nd Small Claims Court of the District of Niterói/RJ, authorized the execution of judicial warrant via the email or telephone of the Defendant, due to the “restrictive measures to the commerce, adopted by the municipality of Rio de Janeiro, during the pandemic”.
The warrant is aimed to compel the certifying company Certisign, to renew the digital certificate (token) of the Plaintiff, a lawyer who was prevented from digitally signing and filing his petitions in digital lawsuits, due to the expiration of his digital certificate.
The request for the execution of the warrant via the Defendant’s e-mail or telephone was requested by the Plaintiff, after a first fruitless attempt of the warrant’s execution by the bailiff, since, in view of the restrictions imposed by public authorities to the operation of establishments due to the pandemic, there are no employees or representatives of the Defendant at its address.
